Welcome to PetThrow. These Terms of Service ("Terms") govern your access to and use of petthrow.com (the "Site") and any products, services, and content offered by Tegarty LLC ("PetThrow," "we," "us," or "our"). By accessing or using the Site, placing an order, or otherwise engaging with our products, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

PetThrow is operated by Tegarty LLC, a limited liability company registered in Wyoming, USA. We design and sell pet enrichment products, including silicone lick mats and related accessories, for dogs and cats.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on our Site. By using the Site, you represent that you meet this requirement.

3. Products and Product Descriptions

We attempt to describe and display our products, including materials, dimensions, and colors, as accurately as possible. However, we do not warrant that product descriptions, images, or other content on the Site are accurate, complete, reliable, current, or error-free. Colors may vary slightly due to photography and display settings.

All products are intended for use with domestic dogs and cats under owner supervision. See Section 9 (Product Use and Pet Safety) for important safety information.

4. Pricing and Payment

  • All prices are listed in U.S. dollars unless otherwise noted and are subject to change without notice.
  • We reserve the right to correct any pricing errors, even after an order has been placed, and to cancel any order affected by a pricing error, with a full refund issued.
  • Payment is processed at the time of purchase through our secure third-party payment processors. We do not store your full payment card details.
  • Applicable sales tax will be calculated and added at checkout based on your shipping destination, where required by law.

5. Orders and Order Acceptance

Your receipt of an order confirmation does not constitute our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right, at any time after receipt of your order, to accept or decline your order for any reason, including product availability, errors in pricing or product information, or suspected fraudulent activity.

6. Shipping and Delivery

Shipping timelines provided at checkout or on our Site are estimates only and are not guaranteed. Tegarty LLC is not responsible for delays caused by carriers, customs, weather, or other events outside our reasonable control. Risk of loss and title for products purchased pass to you upon our delivery to the shipping carrier.

8. Amazon and Third-Party Marketplace Purchases

If you purchase PetThrow products through Amazon or another third-party marketplace, that marketplace's own terms of service, return policy, and customer service procedures will govern your purchase, in addition to these Terms where applicable to your use of this Site.

9. Product Use and Pet Safety

Your pet's safety is important to us. Please observe the following when using PetThrow products:

  • Always supervise your pet while using any PetThrow product, including lick mats, slow feeders, and related accessories.
  • Suction-based products are designed for use on smooth, non-porous, food-safe surfaces (such as tile, glass, stainless steel, or a bathtub). Do not use suction products on hardwood, carpet, or other surfaces where suction may not securely hold.
  • Inspect products regularly for damage or excessive wear, and discontinue use if you notice cracking, tearing, or other deterioration.
  • PetThrow products are designed to provide calming distraction and enrichment. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any condition. If your pet has specific dietary, behavioral, or medical needs, consult your veterinarian before use.
  • Wash products before first use and clean regularly according to the care instructions provided with your product.

Tegarty LLC is not liable for any injury, illness, or damage resulting from misuse of our products, use inconsistent with the provided instructions, or lack of adult supervision during use.

10. Intellectual Property

All content on the Site, including text, graphics, logos, product images, and the PetThrow name and branding, is the property of Tegarty LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

11. User Conduct

When using the Site, you agree not to:

  • Violate any applicable local, state, national, or international law.
  • Submit false or misleading information, including in product reviews or customer service communications.
  • Interfere with or disrupt the Site or servers/networks connected to the Site.
  • Attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site.
  • Use the Site for any fraudulent or unlawful purpose.

12. User-Generated Content

If you submit reviews, photos, videos, comments, or other content to us (including via social media or email), you grant PetThrow a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display that content in connection with our marketing and promotion of our products, unless otherwise agreed in writing.

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE PROHIBITED BY LAW.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TEGARTY LLC, ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS. These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Wyoming, unless otherwise required by applicable consumer protection law in your jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
